Right of cancellation and consequences

Based on the regulations stipulated in the Distance Selling Act, purchasers are entitled to cancel their order as follows:

Purchasers are entitled to cancel their order in writing (letter, fax, email) or by returning the ordered products within one month without indicating any reason for the cancellation. The deadline of cancellation begins no sooner than the receipt of the products and the advice about the right of cancellation. Timely dispatch is sufficient for the observation of above deadline. The right of cancellation does not apply to any products specified in § 312 paragraph 4 BGB that are specifically manufactured according to customer specifications or clearly customized to the personal needs of the customer or which, by virtue of their composition, are not appropriate for being returned or can rapidly become spoiled or the expiration date of which would be exceeded.
In the case of an effective withdrawal, the mutually received payments must be returned and, if necessary, the uses made must be published. The user must pay compensation for any deterioration resulting from the use of the goods in accordance with the regulations. The user may inspect the goods carefully and cautiously. The loss of value resulting from the use beyond the inspection which leads to the fact that the goods cannot be sold as new, must be compensated for by the user. This does not apply if the deterioration of the goods is exclusively attributable to the inspection that would have been possible in the retail shop. Incidentally, the obligation to pay compensation for the loss of value can be avoided if the user does not put the goods to use like an owner and refrains from any action which could reduce their value. Packable items must be sent back. Non-packable items are collected from the user.
The costs of returning the goods are borne by the user in the event of the exercise of the right of withdrawal for an order value of up to € 40, unless the delivered goods do not correspond to the goods ordered. In the event of an order value exceeding € 40, the user is not required to bear the costs of returning the goods.
In the event of effective cancellation, the services received by either party shall be returned and any benefits that may have been accrued shall be released. If the consumer is unable to return the received goods either in total or in part or only in deteriorated condition, the consumer shall indemnify Christine Bendel for the loss in value, if applicable. This shall not apply in the event that the deterioration of the surrendered goods is due to the inspection of the goods – as it would have been possible in a shop. The consumer may, moreover, avoid such liability of indemnification if he refrains from using the goods as if he owned them and further refrains from any action that would diminish the value of the goods. Goods capable of being sent by parcel will be on request of the consumer collected from him or shall be sent back. The consumer shall bear the costs of the return shipment if the goods delivered are as ordered and the value of the returned product does not exceed € 40,- or if in case of a higher value of the product the consumer has at the time of the revocation not performed the return service or the agreed partial payment. Otherwise, Christine Bendel shall bear in case of a valid revocation the costs for the return shipment respectively the collection.
